The guidelines are intended to protect the rights of actors and other performing artists, while also serving as a framework for AI-related businesses to conduct their activities safely. \u00a0The guidelines tackle topics such as the handling of permissions and royalties, as well as the ethical issue of copying voices of deceased actors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This comes after a series of cases in recent years involving the unauthorized use of celebrities\u2019 voices and likeness in AI-generated videos and images, with one of <a href=\"https:\/\/automaton-media.com\/en\/news\/voice-actor-kenjiro-tsudas-lawsuit-over-ai-voice-cloning-dismissed-but-ruling-sets-important-precedent-for-protecting-seiyuu-voices-in-japan\/\" target=\"_blank\" rel=\"noreferrer noopener\">the most impactful examples<\/a> being veteran voice actor Kenjiro Tsuda\u2019s lawsuit over a TikTok account featuring videos that imitated his voice using generative AI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As there are no laws in Japan that directly protect voice rights, The Japan Actors Union and other organizations representing performing artists have been <a href=\"https:\/\/automaton-media.com\/en\/news\/evangelion-and-danganronpa-star-megumi-ogata-says-she-is-heartbroken-over-unauthorized-ai-voice-generation-why-cant-japan-establish-content-guidelines\/\" target=\"_blank\" rel=\"noreferrer noopener\">continuously pushing for legal reforms<\/a> in wake of the issue. It will be mandatory for AI companies to clearly state their purpose and obtain permission from the person whose voice they want to use in AI training. This will allow voice actors and other performers to have control over when, where and how their voices are used.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Additionally, the use of AI-generated voices will be defined as a new form of \u201cperformance,\u201d which means that companies will have to pay appropriate compensation or royalties to actors. According to The Japan Actors Union, this ensures that AI will become a tool that allows actors to \u201clicense their own voices and generate revenue,\u201d rather than being seen as \u201ca job-stealing threat.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When it comes to automatic translations (AI-generated audios that mimic an actor\u2019s voice in another language), the guidelines protect the artistic integrity of the original performance, and guard actors against unauthorized use in overseas regions. In the case of content getting multi-language translations, actors are guaranteed the right to obtain new usage licenses and additional compensation to account for global distribution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Interestingly, the guidelines also touch on the topic of AI-generated \u201cclones\u201d that replicate the voices of deceased actors, which is also one of the big ethical issues caused by the rapid proliferation of AI technology. According to the Japan Actors Union, the new guidelines protect the dignity, reputation and legacy of deceased actors from commercial exploitation. Therefore, companies will be banned from using deceased actors\u2019 voices for AI, with the exception of projects that the deceased had agreed to participate in during their lifetime.
