Guest speakers included legal representatives from major Japanese game companies like Capcom, Nintendo, Sega, Konami and Koei Tecmo.\u00a0<\/p>\n\n\n\n<p>One of the topics discussed during the conference was the handling of intellectual property rights (such as patents, copyrights and trademarks) among industry competitors (as reported by <a href=\"https:\/\/game.watch.impress.co.jp\/docs\/news\/1653862.html\" target=\"_blank\" rel=\"noreferrer noopener\">GameWatch<\/a>). Video game-related patents and litigation involving them are controversial topics for developers and gamers alike, as some consider them to be detrimental to innovation and a means for big companies to monopolize technology while \u201cbullying\u201d smaller peers. However, the Tokyo eSports Festa conference offered some counter arguments in favor of fortifying protection of intellectual property in the game industry.&nbsp;<\/p>\n\n\n\n<p>Before moving on, please note that intellectual property laws differ depending on the country, and that patents are territorial rights, meaning they are only applicable in the country they were granted in. The following is centered on Japan and how Japanese companies handle their intellectual property.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1190\" height=\"672\" sizes=\"auto, (max-width: 1190px) 100vw, 1190px\" src=\"https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/10\/20241008-38003-headeer.jpg\" alt=\"\" class=\"wp-image-38006\" srcset=\"https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/10\/20241008-38003-headeer.jpg 1190w, https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/10\/20241008-38003-headeer-380x215.jpg 380w, https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/10\/20241008-38003-headeer-768x434.jpg 768w\" \/><\/figure>\n\n\n\n<p>Kikuo Matsumoto, head of Sega\u2019s Corporate Development HQ (in charge of legal, HR and IP affairs) started off by establishing that the game industry has evolved through creators \u201cimitating\u201d and building upon each other\u2019s ideas, and that there is nothing wrong with taking inspiration from the works of another company.&nbsp;<\/p>\n\n\n\n<p>On the other hand, Matsumoto mentions that there is a limit to how much you can \u201cimitate\u201d before it becomes a problem (however, he notes that cases of \u201cmalicious\u201d infringement have drastically decreased in recent years). Sega takes action only when this limit is exceeded.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"900\" height=\"506\" sizes=\"auto, (max-width: 900px) 100vw, 900px\" src=\"https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/11\/20241107-39442-header.jpeg\" alt=\"Virtua Fighter esports\" class=\"wp-image-39445\" srcset=\"https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/11\/20241107-39442-header.jpeg 900w, https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/11\/20241107-39442-header-380x214.jpeg 380w, https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/11\/20241107-39442-header-768x432.jpeg 768w\" \/><\/figure>\n\n\n\n<p>As for patents specifically, Matsumoto explained that Sega is actively filing patent applications for new technological solutions that arise during game development, and this has a lot to do with how expensive it&#8217;s become to make games. Sega does not register patents so that it can monopolize technology and use it exclusively, but rather with the policy that other parties can use Sega\u2019s solutions as long as they apply for a license and pay an appropriate price for it.&nbsp;&nbsp;<\/p>\n\n\n\n<p>He doesn\u2019t say it directly, but Matsumoto seems to be implying that patent registrations are an important source of income that Sega needs in order to sustain its high-cost game development. Thus, the objective is not to block peers from using the technology, but to secure royalties.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Shunsuke Murase, the general manager of Konami\u2019s legal department, spells this out more clearly, commenting that with development costs ballooning to billions of yen per title, licensing out new technology and game mechanics to other companies is an important means of recouping investment. He also suggested that if Konami didn\u2019t adequately protect the inventions born from their developers\u2019 research, the developers would lose their incentive, negatively impacting innovation in future games and creating a \u201cvicious cycle.\u201d&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"900\" height=\"506\" sizes=\"auto, (max-width: 900px) 100vw, 900px\" src=\"https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/07\/20240702-33273-header.jpeg\" alt=\"Metal Gear Solid Delta Snake Eater Naked Snake\" class=\"wp-image-33280\" srcset=\"https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/07\/20240702-33273-header.jpeg 900w, https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/07\/20240702-33273-header-380x214.jpeg 380w, https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/07\/20240702-33273-header-768x432.jpeg 768w\" \/><\/figure>\n\n\n\n<p>Capcom offers another angle. Motoki Okuyama, general manager of Capcom\u2019s legal division, suggested that patents indirectly play an important role in protecting the brand. According to Okuyama, the damage bootleg products and copies can do to one\u2019s brand is serious enough to \u201cjeopardize the survival of the company.\u201d But as copyright laws can\u2019t be used to protect game ideas themselves, Capcom uses a \u201cmixed intellectual property strategy,\u201d actively pursuing patent registrations as well as trademarks. &nbsp;<\/p>\n\n\n\n<p>As it\u2019s notoriously difficult to prove copyright infringement in litigation, Okuyama may be suggesting that patents are a useful tool to fall back on instead. On a somewhat related note, people were surprised when Nintendo and The Pok\u00e9mon Company sued Palworld developer Pocketpair over patent infringement rather than copyright infringement, but <a href=\"https:\/\/automaton-media.com\/en\/news\/whats-the-killer-patent-nintendo-is-suing-palworld-for-japanese-patent-attorney-offers-in-depth-analysis\/\" target=\"_blank\" rel=\"noreferrer noopener\">legal experts have suggested<\/a> that this decision was made because Palworld \u201cnarrowly avoids\u201d the kind of similarities that could legally constitute copyright infringement, making patent-related litigation a safer bet.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"1057\" height=\"595\" sizes=\"auto, (max-width: 1057px) 100vw, 1057px\" src=\"https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/03\/20240315-28581-header.jpg\" alt=\"Street Fighter 6 gameplay\" class=\"wp-image-28584\" srcset=\"https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/03\/20240315-28581-header.jpg 1057w, https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/03\/20240315-28581-header-380x214.jpg 380w, https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/03\/20240315-28581-header-768x432.jpg 768w, https:\/\/automaton-media.com\/en\/wp-content\/uploads\/2024\/03\/20240315-28581-header-600x338.jpg 600w\" \/><\/figure>\n\n\n\n<p>That\u2019s not to say that Capcom is holding onto patents solely with litigation in mind, as Okuyama, much like Sega and Konami\u2019s representatives, also stresses the importance of mutually licensing out technologies among peers.&nbsp;<\/p>\n\n\n\n<p>Lastly, Nintendo\u2019s patent attorney and legal department head Koji Nishiura explained that Nintendo actively acquires various forms of intellectual property rights (such as patents, design rights, trademarks and copyrights) because each can provide a different scope of legal protection. Nintendo takes advantage of said rights in a multifaceted way to protect their brand.
